Terms and Conditions

These Terms govern access to and use of Certuma Link, a clinician-supervised software service operated by FLORA FERTILIDAD ARG S.A.S.,CUIT 30-71896126-9, with legal notice address at Av. del Libertador 8142, Autonomous City of Buenos Aires, Argentina. By creating an account, opening a patient link, or using the service, you accept these Terms. If you do not agree, do not use Certuma Link.

1. Service overview

Certuma Link helps clinicians collect patient messages, organize case context, receive AI-assisted drafts, communicate with patients, and manage payment or administrative workflows. The software is a communication and workflow tool. It is not a licensed medical provider, insurance plan, pharmacy, or replacement for professional judgment.

2. Beta and availability

Some features may be in beta, limited release, or local pilot operation. Beta features may change, pause, or fail, and may be provided without charge while they are being evaluated. We may modify or discontinue a feature when needed for safety, security, provider availability, legal requirements, or product reliability.

3. Eligibility and accounts

Clinician users must be legally permitted to provide care in the place where they practice and must provide accurate identity, credential, payment, and contact information. Patients may use Certuma Link only through an authorized clinician link or session. You are responsible for keeping credentials, devices, and session access secure.

4. AI assistance and clinician responsibility

AI features are limited to intake, routing, summarization, draft preparation, and administrative support. AI output is not a final clinical decision. A licensed clinician must review the relevant information and decide what, if anything, should be sent to a patient. Clinicians are responsible for the accuracy, appropriateness, timing, and legal compliance of their own care decisions and messages.

5. Urgent situations

Certuma Link is not designed or enabled for urgent, life-threatening, or time-critical situations. Patients should not use the service for severe symptoms, danger to self or others, loss of consciousness, severe breathing difficulty, severe chest pain, major bleeding, stroke-like symptoms, or any situation that may require immediate attention. In those cases, call the local emergency number, such as 107 or 911 in Argentina, or go to the nearest appropriate medical facility.

6. Patient communications

Patients must provide accurate information and understand that electronic communication can be delayed, incomplete, or affected by device, network, or service issues. Clinicians choose whether to answer, request more information, escalate, close, refund, or decline a case. Certuma Link may show status messages, reminders, and safety copy, but it does not guarantee response time or outcome.

7. Payments, fees, and refunds

Payments may be processed by third-party payment providers. Clinicians are responsible for their own prices, tax obligations, patient refund decisions, and any professional or marketplace obligations unless a separate written agreement says otherwise. Platform fees, subscription fees, payout timing, chargebacks, disputes, and refunds may depend on the payment provider and the clinician account configuration.

8. Privacy and data

Use of Certuma Link involves personal data and sensitive health data. Our Privacy Policy explains collection, use, retention, processors, analytics, security, data subject rights, and contact channels. You must not upload real data unless you have authority to do so.

9. Acceptable use

You may not misuse the service, bypass security, share access with unauthorized people, impersonate a clinician or patient, upload unlawful content, interfere with the platform, scrape or reverse engineer the service, use it to send spam, or rely on it for autonomous clinical decisions. We may limit, suspend, or terminate access when needed to protect patients, clinicians, the platform, or legal obligations.

10. Intellectual property

Certuma Link, its software, workflows, designs, names, marks, content, and AI orchestration are owned by FLORA FERTILIDAD ARG S.A.S. or its licensors. These Terms grant only the limited right to use the service as intended. No ownership rights are transferred.

11. Disclaimers and liability

The service is provided as available and as permitted by law. We do not guarantee uninterrupted access, error-free AI output, provider availability, payment approval, or any clinical, financial, regulatory, or business result. To the maximum extent allowed by law, FLORA FERTILIDAD ARG S.A.S. is not liable for indirect, incidental, special, punitive, or consequential damages, and aggregate liability is limited to the fees paid to us for the service in the 12 months before the claim.

12. Law, jurisdiction, and contact

These Terms are governed by the laws of the Argentine Republic. Unless a separate written agreement or deployment-specific notice says otherwise, disputes will be submitted to the ordinary commercial courts with jurisdiction in the Autonomous City of Buenos Aires, Argentina. 13. Changes

We may update these Terms when the service, legal requirements, providers, markets, or operating model change. Updated Terms will be posted on this page. Continued use after an update means you accept the updated Terms.
